 User Agreement

1.              Introduction

1.1            EU Lotto Limited t/a Lottoland.co.uk is a company registered in Gibraltar under company number 109514, with its registered office at Suite A, Ocean Village Promenade, Ocean Village, Gibraltar GX11 1AA (“Lottoland”, “we”, “us” or “our”).

1.2            We operate our  Website (which includes www.lottoland.co.uk, Lottoland.com and related domains and subdomains plus mobile or app versions from time to time), through which we enable registered users (“Users”, “you” or “your”) to place real money bets and stakes (“Bets”, “Bet” or “Betting”) on our Services (as defined below).

1.3            The services we offer to Users of our Website include some or all of the following depending on Users location: :

1.3.1             Betting on the results of official lotteries and/or lottery-style draws using certified random number generator technology (“Lottery Betting”).

1.3.2             Betting on global financial market data such as the New York Stock Exchange (“Financial Market Betting”);

1.3.3             Participating in certified  random number generator based games offered by Lottoland such as scratchcards, Instant win games, Casino and Table games, Slots, Live Casino and Bingo (“RNG Games”)

1.3.4             Betting on sports events (“Sports Betting” or a “Sports Bet”) where made available in your location; and

1.3.5             the Alternative Service (as defined in the rules on Winnings for Lottery Betting and Financial Market Betting at paragraphs 2.30 to 2.35),

(each a “Service” and together, the “Services”).

KEY TERMS OF THE USER AGREEMENT ARE HIGHLIGHTED IN BOLD, SO PLEASE PAY PARTICULAR ATTENTION TO THEM.

1.4            Please note that Lottoland is not a lottery operator and you are not buying a ticket with an applicable lottery. Rather with Lottoland, when participating in Lottery Betting and Financial Market Betting, Users are placing Bets with Lottoland or a Lottoland partner on the results of the draws of official and/or state-run lotteries and/or lottery-style draws using certified random number generator technology and/or on certain Financial Market data.

1.5            Licences: Lottoland is officially licenced by:

1.5.1             the Gambling Commission of Great Britain, to offer remote betting on real and virtual events, bingo and casino activities (Licence Number 38991), to players in Great Britain (“GB”) in accordance with the laws of England and Wales. 1.5.2             the Government of Gibraltar to accept Bets (licence number RGL 066) and to offer Casino-style products (Licence Number RGL 085), to non-GB players in accordance with the laws of Gibraltar. 2.              Understanding these Terms of Use

2.1            This User Agreement and the documents referred to in it (together, referred to as the “Terms and Conditions”) tell you the terms on which you are permitted to use the Website and our Services. Please read the Terms and Conditions carefully before you start to use the Website, along with our Privacy Policy and Cookie Policy. By using the Website you indicate that you accept the Terms and Conditions and that you agree to abide by them. At this point a legally binding agreement on the Terms and Conditions is concluded between you and us. If you do not agree, you must not use the Website.

2.2            Please also note that the Terms and Conditions are subject to change from time to time. Users will be notified prior to their next login or via email,  when material changes are made to the User Agreement. The Terms and Conditions will be accessible to you on our Website and will apply from the date of their display.

2.3             The Terms and Conditions include the following documents:

2.3.1             this User Agreement;

2.3.2             the rules on Lottery Betting and Financial Market Betting (“Rules on Lottery Betting and Financial Market Betting”) found here;

2.3.3             the rules on Sports Betting (the “Sports Betting Rules”) found here;

2.3.4             our RNG Game Rules found here;

2.3.5             any terms, conditions and rules of any special offers, promotions or bonuses which may appear on the Website from time to time;

2.3.6             any terms, conditions and/or rules provided by third party providers as a condition of play on or for any RNG Game, or other service provided by a third party (together the “Third Party Rules”); and

2.3.7             our Privacy Policy found here and Cookie Policy found here.

2.4            In the case of any conflict between this User Agreement and the promotion-specific terms and conditions, this User Agreement will always take precedence over any promotion-specific terms and conditions to the extent of any conflict or inconsistency.

3.              Definitions

3.1            When certain words and phrases are used in this User Agreement, they have specific meanings (these are known as “defined terms”). You can identify these defined terms because they start with capital letters (even if they are not at the start of a sentence).

3.2            Where a defined term is used, it has the meaning given to it either: (i) below; or (ii) in the section of these Terms where it was defined (you can find these meanings by looking at the sentence where the defined term is included in brackets and speech marks).

 

 

4.              The Website

4.1            Access to the Website is permitted on a temporary basis. We reserve the right to withdraw or amend the Website and our Services without notice, subject to any applicable provisions of the Terms and Conditions relating to open Bets and your funds. We will not be liable to you if for any reason the Website is unavailable at any time or for any period and we do not guarantee that the Website, or any content on it, will always be available, error free, or be uninterrupted.

4.2            We may update the Website and/or change the content on it at any time. Any of the material on the Website may be out of date at any given time, and unless otherwise required by law, regulation or these Terms and Conditions, we are under no obligation to update such material.

4.3            We restrict access to some parts of the Website to Users who have registered with us. We may suspend access to the Website, or close it indefinitely, subject to any applicable provisions of these Terms and Conditions.

4.4            You are responsible for making all arrangements necessary to have access to the Website. You are also responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms and Conditions and that they comply with them.

5.              Registration

5.1            You are free to browse the Website but if you want to use the Service e.g. place a Bet, you are required to open an account with us (your “Account”) by completing the registration form on the Website.

5.2            By applying to register with us you declare and confirm that:

5.2.1             you are at least 18 years old or older if required by the laws of your location (under-age gambling is an offence);

5.2.2             you have legal capacity and authority to enter into these Terms and Conditions;

5.2.3             you do not have any other account open on the Website;

5.2.4             you are acting on your own behalf and not on behalf of anyone else;

5.2.5             it is not illegal to enter into these Terms and Conditions in the country where you live and you will not engage in any of the Services in any jurisdiction in which it would be illegal to do so;

5.2.6             the information provided on the registration form is accurate correct and will be kept up-to-date, including your name, date of birth, postal address, email addresses, payment method data and any other information used to authenticate your identity from time to time;

5.2.7             registration and membership is and remains subject to suitable identity or account verification information being provided to us within a reasonable time after being  requested;

5.2.8             you are aware that losses can be incurred Betting with us and you agree to be responsible for any such losses;

5.2.9             you are authorised to make any payments that you make as a result of using our Services and will at all times keep those payment and account details safe and secure and otherwise act in good faith in relation to those payments and to our Services overall;

5.2.10          you shall not deposit monies originating from criminal and/or unauthorised activities;

5.2.11          you are not a person who:

5.2.11.1           (i) any person, citizen of, or resident in a country listed by the Financial Action Task Force (“FATF”) as being a high risk jurisdiction subject to a call for action as communicated from time to time by the FATF (Including at: http://www.fatf-gafi.org);

5.2.11.2           is listed on the Financial Sanctions List of HMRC; and

5.2.11.3           is a citizen of or resident in the United States of America, Cuba, Syria, Venezuela, Russia, Ukraine or Belarus;

5.2.12          you understand that you will be solely responsible for the payment of any taxes, levied, due or charged in connection with your use of our or the results of our Services including in respect of Winnings, as and where applicable;

5.2.13          you are not at the time of registration (a) a director, officer, employee (or the spouse or dependant of any of the foregoing) of Lottoland or of any of the Lottoland Group companies; or (b) a person which Lottoland believes to be in a position to manipulate the outcome of a Bet; and

5.2.14          you have read and understood these Terms and Conditions and agree to be fully bound by them.

5.3            As a consequence of you applying to register with us, you agree that we may verify your identity and the accuracy of the information you provided on our registration form, including without limitation by requiring further information and/or proof of identity from you, and that we may pass your information on to third parties (including credit reference agencies) in order to do so. Failure to provide satisfactory verification information and/or proof of identity to us may lead to your Account being rejected at the application stage, or subsequently suspended or terminated. You will not be permitted to deposit funds in your Account and/or use our Services unless and until we have verified your identity and that you are at least 18 years of age.

5.4            We reserve the right in our absolute discretion to refuse any application for registration and are not obliged to provide a reason for any such refusal.

5.5            If your application to register is successful, then we will inform you that your Account has been created.

5.6            As part of the Account opening process you will be required to choose a username and password for your Account. You must treat your username, password and Account details as confidential at all times and you must not disclose them to any third party. If you become aware or suspect that a third party has access to your password and/or your Account details you must inform us immediately at support@lottoland.co.uk

5.7            You agree that you are responsible for any use of your Account by a third party where such use is permitted or authorised by you and/or due to your fault or negligence. We are entitled to assume that any Bets placed using your Account have been placed by you where your password and login information has been correctly supplied, unless you are able to demonstrate to our reasonable satisfaction that use of your Account by a third party was not: (i) permitted nor authorised by you; or (ii) due to your fault or negligence. We will not be responsible or liable to you for any loss that you may incur as a result of misuse of your password, and we accept no responsibility or liability resulting from its use by a third party, where you are unable to demonstrate to our reasonable satisfaction that such use is not: (i) permitted or authorised by you; or (ii) due to your fault or negligence.

6.              Underage Users

6.1            It is a criminal offence to use our Services if you are under 18 (or the legal age of gambling in the place where you are located). We take our responsibility to prevent those under 18 from using our Services very seriously. If we are informed or otherwise become aware that you are under 18 or were under 18 when you used our Services, then your Account will be immediately suspended whilst we investigate. Should we find that you are or were under 18 when you used the Services we will refund to you any amounts deposited into your Account but will retain any Winnings which you may have or are due to your Account, and you must pay us on demand any other Winnings gained from Bets placed whilst you were underage.

6.2            We would like to draw the attention of Users who are parents or have custody over children under 18 to parental responsibility over facilities such as mobile phones and tablets. We recommend that parents and guardians who use family shared devices use the parental controls settings on these devices in order to restrict access to the Services from children and minors. Underage gambling is an offence and we reserve the right to report any underage Users to the police.

7.              Managing your Account

7.1            Your Account is personal to you and may not be transferred to a third party without our prior written consent.

7.2            You agree to inform us immediately of any change to your information that you provided at the time you registered with us or as soon as you are aware of any mistakes or inaccuracies in the information that we hold about you. To the extent permissible, you may also self-manage your data and Account information at any time through your Account.

7.3            You shall immediately inform us if your bank card or a comparable payment method specified on the Website, becomes lost, suspended or stolen. It is your obligation to report suspected fraud or illicit use of your Account and to take such steps as may be required in order to overcome it, such as by changing the password on your Account.

7.4            You may close your Account permanently on the Website through your Account settings or by contacting our  Customer Service Team here.  Bets made prior to closure will stand and Winnings (if any) will be relayed to the payment method specified on the Account. Balances within your player wallet will (subject to these terms) be returned to you following closure. If you close your Account and then open a new Account, we have the right to close such new Account. You may also wish to consider our responsible gambling page here) if any closure has been prompted by any concerns as to the extent, frequency, and/or amount you have spent gambling.

7.5            For further information on what steps you can take to help ensure that you use our Services responsibly, please see the Responsible Gambling section (section 14) below.

7.6            We are entitled to deem your Account as inactive if more than one year has passed since the last stake or transaction by you (i.e. placing a Bet or playing any RNG Games). Lottoland will notify you once your account has been deemed as inactive. Thereafter:

7.6.1             for non-GB Users, if the Account is still deemed as inactive 30 days after notification by Lottoland, a monthly inactive account fee of 5.00 EUR (or equivalent currency) shall be payable (“Inactive Account Fee”). The Inactive Account Fee will be deducted from the User’s Account balance until the earlier of: (a) the User’s Account balance being reduced to zero; (b) the User’s Account being reactivated by the User to carry out Betting activity; or (c) the User closing their Account (in which case, the balance remaining will be paid to the User); or

7.6.2             for GB Users only, Lottoland will attempt to repay any balance in your Account using the payment method last used to deposit funds. If that is not possible for any reason, a User’s Account that is still deemed as inactive 30 days after notification to the User by Lottoland incurs a monthly administrative fee of 5.00 GBP. Lottoland is entitled to deduct this monthly administrative fee until the earlier of: (a) six months; (b) the User’s Account balance being reduced to zero; (c) the User’s Account being reactivated by the User to carry out Betting activity; or (d) the User closing their Account (in which case, the balance remaining will be paid to the User.

8.              Your funds: Deposits and Withdrawals

8.1            Before you can place a Bet, you must deposit funds into your Account. You will not be entitled to place a Bet unless you have sufficient funds in your Account to do so. The amount you will have available to place a Bet is represented by your 'Available Funds' balance set out on the Website. You agree to let us know immediately if you become aware of any errors in respect of the funds in your Account or the ‘Available Funds’ balance shown.

8.2            Before you can deposit funds you will first need to register a valid payment card. Your card details will only be stored with the applicable payment service provider. We will only store the last 4 digits of your account number for the purpose of PCI compliance. Credit cards are not a payment option for our GB-based users.

8.3            The name on the card or the bank account or any other payment method should be identical to that of the Account holder. If we identify that funds have been deposited to your Account from a third party, we reserve the right to either: (a) immediately return the deposit back to the source and void any Winnings from Bets placed that have arisen from such a deposit; or (b) assume (on the basis of the declaration in Section 5) that the User is using their own funds, and Lottoland accepts no liability where that is not the case. Any charges levied by the banks and/or payment gateways will be deducted from any reversed amount (if applicable).

8.4            Lottoland shall be entitled in its sole discretion to define different minimum and maximum amounts for deposits and Betting during a particular time period for you, but is under no obligation to you to do so.

8.5            Funds deposited or withdrawn with us in your Account will show up as "Lottoland" on your card statements. Lottoland will credit payments from Users to Lottoland’s bank account immediately upon receipt of funds. A User must state their ‘player number’ with all bank transfers.

8.6            With a direct debit order and authorisation respectively, you authorise Lottoland or its appointees to debit the relevant amount from the bank account provided by you.

8.7            You agree not to make any charge-backs, reversals or otherwise cancel any deposits into your Account, and in any such event, to refund and compensate Lottoland for such unpaid deposits including any expenses incurred by Lottoland in the process of collecting such unpaid deposits. In addition, in the case of a returned direct debit from you, Lottoland may reject further payments from you and applicable bets if any will not be placed upon any returned payment. Lottoland is entitled to transfer any such claims against you, including any applicable additional fees to a collection agency.

8.8            If payment to Lottoland from a User has ceased, is interrupted, returned or for any other reasons not finalised, or in case that such payment is cancelled afterwards, or theft or fraud is  reasonably apparent  in this regard, Lottoland shall be entitled to cancel any applicable Bet or debit the relevant amounts from the User’s Account (where a balance is available), including any additional fees imposed on Lottoland by virtue of the User’s failure to make payment.

8.9            Any third-party bank and payment processing charges and fees are borne by the User and Lottoland is entitled to debit a User’s Account accordingly a sum which reflects its actual processing costs. This also applies to foreign exchange charges. Lottoland reserves the right to charge the User a fee for handling deposits and withdrawals to and from their Account if a deposit is not played through in its entirety before a withdrawal is requested, particularly in respect of multiple or vexatious requests. Fees charged will be 5% of the withdrawal amount or £2 minimum.

8.10         Funds cannot be transferred from the Account of one User to the Account of another User.

8.11         Your Account is provided only for the purpose of you using our Services through the Website. It is not provided for use as a banking facility. Money deposited in your Account will not earn any interest. If you appear to make deposits and withdrawals which do not relate to genuine Bets, we reserve the right to suspend and/or close your Account.

8.12         The credited amount deposited by Users and the payable credit balance on a User’s Accounts respectively are held in a bank account in the name of Lottoland and are not subject to any particular escrow or mechanisms for protection in the event of insolvency. This does not apply to Users in the United Kingdom, where User funds are held in a separate account (see section 8.13 below).

8.13         We are required by our British licence to inform GB residents about what happens to funds which we hold on account for them in the event of insolvency https://www.gamblingcommission.gov.uk/licensees-and-businesses/guide/page/protecting-customer-funds For GB residents, we hold User funds separate from company funds in separate bank accounts which we hold with our banking suppliers. However, these funds may still form part of the assets of the business and are not protected in the event of insolvency. This meets the British Gambling Commission’s requirements for the segregation of customer funds at the level: not protected.

8.14         You may log in to your Account to view a statement of account which will show all transactions effected on that Account, namely deposits, bonuses, Winnings, withdrawals, Bets sent or received but not accepted, Bets accepted where the event has not started, Bets accepted where the event is live and Bets accepted where the event has completed.

8.15         A User can only withdraw funds to a bank account in the name of the User.

8.16         You can directly withdraw funds that constituted legitimate Winnings under the “My Transactions” section of the Website. In order to mitigate money laundering and fraud, funds from unspent deposits can only be Withdrawn by contacting Customer Support. Under no circumstances will a User be able to withdraw any bonus funds from their Account (the foregoing does not, however, apply to players’ own funds which may be withdrawn at any time subject to any necessary checks). For non-GB Users only: a withdrawal limit of €/£5.00 (or equivalent currency) applies - further details on how to withdraw money from the User Account can be found in the FAQs, which can be accessed here.

8.17         We will attempt to process any withdrawal requests within five (5) working days from receipt of such request. However, some withdrawal requests may take longer where payment details  provided  to us have changed or where they are subject to additional confirmation (e.g. large wins), or we are required to verify elements of that request for legal or regulatory reasons (including additional and required AML checks).

8.18         You acknowledge that we may only process withdrawal requests once any applicable identification and/or verification checks that we are required to carry out under applicable law and/or regulation have been satisfied. If within two weeks of a withdrawal request being made, Lottoland requires additional verification but is unable to verify your identity to its satisfaction, the withdrawal request will be cancelled and the funds returned to your Account.      

8.19         All deposits, transfers and withdrawals may be checked to prevent money laundering. We retain the right to make any queries regarding the source of any funds deposited with us. Should you fail to provide satisfactory responses to our queries, we may suspend the Account and all Account functionality, including, but not limited to, Bet management and withdrawal of funds, or close the Account. We may pass on such information, as we deem necessary, to the relevant authorities in accordance with our legal and regulatory obligations in that regard.

9.              Service Rules

PLEASE NOTE: THE FOLLOWING SECTION CONTAINS IMPORTANT INFORMATION ABOUT LOTTOLAND’S RIGHTS TO VOID BETS AND REFUSE TO PAY WINNINGS IN CERTAIN CIRCUMSTANCES.

9.1            The Rules on Lottery Betting and Financial Market Betting (see here) set out the specific rules for, and methods for calculating Winnings for, Lottery Betting and Financial Market Betting. Please review them to understand more.

9.2            Similarly, the Rules on Sports Betting set out the rules relating to Sports Betting (see here). Once again, please do review them to understand more.

10.            Placing Bets

10.1         The process for the placing of Bets by a User is as follows:

10.1.1          the User requests Lottoland to accept Bets by filling out and submitting a virtual play slip on the Website;

10.1.2          after the User has filled out the virtual play slip, it is transferred to the User’s shopping basket;

10.1.3          the User submits their Bet request by clicking on the relevant button in the shopping basket. Where the User’s Account balance is not sufficient the User needs to provide their payment details and Lottoland needs to get satisfactory confirmation of the payment before a Bet request is submitted;

10.1.4          once a Bet request is submitted, it cannot be amended or cancelled by the User; and

10.1.5          Lottoland typically acknowledges receipt of the User’s Bet request by email (except in the case of Sports Betting and most RNG Games). The User may check the processing status of the relevant Bet at any time on the Website in their Account.

10.2         A Bet is not valid until it has been confirmed by Lottoland. The User can check if a Bet has been confirmed by checking the list of active and expired Bets in the “My Games” section of the Website. A Bet is only confirmed once the virtual play slip is labelled “In Play”. The placing of a Bet may be interrupted or prevented as a result of any hardware, software or network failure (for example, due to software or hardware problems or if your internet connection fails, or if the Website or software or Service does not operate properly as a result of any human or technical error). If this happens whilst you are placing a Bet, our records will be definitive evidence of whether or not the Bet was successfully placed before the failure.

10.3         Where a User submits a Bet with DoubleJackpot or NumberShield selected, until the Bet is labelled as “In Play” Lottoland reserves the right to cancel the DoubleJackpot or NumberShield element of the Bet. Where a User has placed a Duration Bet or Subscription Bet with DoubleJackpot or NumberShield selected, Lottoland may at any time cancel the DoubleJackpot or NumberShield element with respect to any of the individual Bets which are not labelled as “In Play”. In either of the events aforementioned in this clause, Lottoland will refund to the Player the price of the DoubleJackpot or Numbershield option for the affected Bet(s).

10.4         The relevant aspects of filling out a virtual play slip are as follows:

10.4.1          at least one Bet needs to be filled in on the virtual play slip. Every Bet is classified either as a separate Bet (“Normal Bet”) or as a combination of Bets (“System Bet”). In a System Bet, all possible combinations of the selected numbers are considered Normal Bets;

10.4.2          (applicable only to Bets placed prior to 05 September 2023) for Lottery Betting only, and provided the DoubleJackpot option has not been also selected, you may select the NumberShield option. NumberShield is an additional option that you can select on the virtual play slip which guarantees your entitlement to undivided Winnings in case of other winners;

10.4.3          for Lottery Betting only, and provided the NumberShield option has not also been selected, you may select the DoubleJackpot option. DoubleJackpot is an additional option on the virtual play slip which doubles the value of a jackpot to which you are entitled if you win;

10.4.4          you may place a bet for a certain duration (“Duration Bets”). Stakes for Duration Bets will be debited by pre-payment at the beginning of the relevant period for all relevant events of the Duration Bet;

10.4.5          you may also automatically extend a Duration Bet by selecting the subscription option (“Subscription Bet”) and by selecting a renewal period from 1 to 52 weeks. After the Subscription period has elapsed the Bets are renewed automatically for the selected period for withdrawal, if no notice of cancellation was received via the User Account. The cancellation of a Subscription must be received by 23:59h of the day prior to the day the period for withdrawal ends. Stakes for any subsequent Duration Bets (due to the automatic renewal of the Subscription) will be debited by pre-payment from any active bank card registered on your Account at the beginning of the relevant period for all relevant events for the Duration Bet; and

10.4.6          for Lottery Betting only, by choosing the option “JackpotHunt” you may automatically extend the virtual play slip until the jackpot in respect to the underlying lottery of the relevant Lottoland game has been won.

10.4.7          for Lottery Betting on MegaMillions only, you may select the option “Megaplier”. When selected, if a winning Bet is in the Type B or Type C Prize Category, the Winnings are subject to a multiplier, such multiplier being the number of the first ball drawn in the draw for the Underlying Lottery (out of either 2,3, 4 or 5).

10.4.8          for Lottery Betting on PowerBall only, you may select the option “PowerPlay”. PowerPlay is an additional option that you can select on the virtual play slip which affects Winnings as follows:

10.4.8.1           for a winning Bet in the Type B Prize Category, Winnings are doubled;

10.4.8.2           for a winning Bet in the Type C Prize Category, Winnings are subject to a multiplier, such multiplier being the number of the first ball drawn in the draw for the Underlying Lottery (out of either 2, 3, 4 or 5). A multiplier of 10 may apply where the relevant Powerball Jackpot amount is less than $150,000,000 (one hundred and fifty million dollars) and the first ball drawn in the relevant draw is 10.

10.5         The deadline for submitting a Bet on a relevant event with be posted on the Website. We are not liable for any failure by you to place a Bet prior to a deadline. A request to place or the apparent placement of a Bet after a deadline or a relevant event has actually occurred will not be valid, irrespective of any automatic confirmation that may be generated via email or the Website, or irrespective of a wrong deadline displayed on the Website.

10.6         Lottoland endeavours to ensure that all the jackpot values for Services offered on the Website are correct but assumes no responsibility for errors contained in such information. Lottoland estimates the amounts of future jackpots using certain assumptions, such as the current or future jackpot being won or rolled over, but is not liable for assumptions that subsequently prove to be incorrect calculations or forecasts.

10.7         Lottoland will use reasonable endeavours to ensure that all results on the Website are correct. Lottoland will not be liable for any mistakes in respect to the information displayed.

11.            Responsible gambling

11.1         We strive to provide a safe gambling environment on the Website. For any GB players  who may have issues with the extent and frequency of their gaming or concerns as to the affordability of their play, we provide player account tools and information to help identify problem gambling and limit, time-out, or suspend their gambling with Lottoland. 11.2         We provide:

11.2.1          voluntary deposit limits set on a daily, weekly or monthly basis;

11.2.2          a voluntary self-exclusion tool (“Self-Exclusion”) that excludes Users for a minimum of six months;

11.2.3          a time-out facility, whereby a User can choose to lock their account for a time period between 24 hours, 1 week or 1 month;

11.2.4          automatic notifications when a User hits a time limit (set by the User) for time spent using the Services; and

11.2.5          links to other useful resources such as GamCare and GAMSTOP, and other gambling help organisations where applicable.

11.3         We allow you to set daily, weekly or monthly deposit limits which enable you to voluntarily restrict the amount of money that can be deposited in a given period of time. You may change your limits at any time. However, requests to set or tighten the deposit limit will be processed immediately, while requests to relax or remove the deposit limit will be subject to a 24-hour waiting period before being processed. We reserve the right to impose greater restrictions on your gambling than the limits you set yourself, and/or to suspend your ability to gamble with us, where we consider it necessary to do so to comply with our regulatory obligations including those relating to responsible gambling.

11.4         If you feel that financial limits are not sufficient to control your gambling, we allow you to voluntarily exclude yourself completely from the Website, with a minimum exclusion period of six months. During that exclusion period, you may not log in, deposit funds or place Bets with Lottoland. Any available funds in your Account will be returned to you. If you would like to self-exclude, please contact the support team here. At the end of the self-exclusion period, if you would like to begin using the Website again you must contact Lottoland Customer Service. Requests to reactivate an Account at the end of a self-exclusion period will be subject to a 24 hour waiting period before being processed.

11.5         We take responsible gambling very seriously, and if you try to open duplicate accounts with us, or to enrol with different details during your period of exclusion we will do our best to detect and close them. If you are able to access our Services, any losses incurred during the period before detection and closure of the duplicate accounts will not be refunded. We also reserve the right to withhold any Winnings that have been obtained, with only the amount deposited returned to you.

11.6         We encourage Users who feel that they cannot control their gambling to utilise filtering software which will block access to gambling websites. Your bank or card issuer may also provide facilities for you to block gambling transactions. 11.8         If you gamble with any other online gambling operators, our GB based players should consider also setting deposit limits or self-excluding with those operators. 12.            Winnings

12.1         Subject to clause 12.3, you can see whether you have won in respect of any Bet via your Account on the Website, although large wins may show but remain subject to final confirmation. Lottoland may also inform you of Winnings via email, text message or by other methods of Lottoland’s choosing. 

12.2         Winnings will be transferred into your Account after the relevant event concerning your Bet has finished, subject to the rules identified below. In the case of:

12.2.1          Lottery Betting, when the applicable Pay Out has been published and otherwise in accordance with the Rules on Lottery Betting and Financial Betting;

12.2.2          Sports Betting, this will be after the relevant result and in accordance with the Sports Betting Rules;

12.2.3          Financial Market Betting, this will be in accordance with the Rules on Lottery Betting and Financial Betting; and

12.2.4          RNG Games, this will be after the conclusion of the applicable game and/or any large win verification and confirmation process in place for sizeable jackpot wins.

12.3         Payment of any Winnings may be subject to the successful completion of any applicable checks and confirmation that Lottoland is required to carry out for insurance, or gaming probity purposes or under applicable laws and/or regulations. Any Winnings credited to a User’s Account in error, (or where large/jackpot win confirmation applies, prior to such confirmation)  and including in the circumstances described in clauses 13.1.9 and/or 13.1.10, are not available for use, and we reserve the right to void any transactions or Bets involving such funds and/or withdraw the relevant amount from your Account and/or reverse the transaction, either at the time or retrospectively.

12.4         For safety reasons, from time to time Lottoland may transfer amounts to your bank account rather than to your Account. This will only occur after a copy of the front and back side of a valid identification document with information that matches your name or maiden name, date of birth and address that you provided in the process of registration and also matches the name on the bank account to which the money is being transferred, has been received and accepted.

12.5         In the event of a dispute in respect of a Bet or the payment or award of any Winnings, Lottoland may withhold payment of the Winnings until any dispute has been resolved between you and Lottoland or otherwise settled by a court or other applicable alternative dispute resolution provider (in accordance with clause 21.4).

12.6         If you reside in a jurisdiction where Winnings are taxable, it will be your own responsibility to keep track of those Winnings and report them to the proper authorities. In the event that Lottoland is required to pay any taxes, duties or levies directly to the regulatory authorities of any country in respect of a User’s Winnings, then it shall be entitled to deduct those from the User’s Account or claim them from the User accordingly.

12.7         Winnings are calculated and credited in EUR except for our Bitcoin Lottery which may be paid in Bitcoin or EUR equivalent as Lottoland may in its sole discretion decide. The exchange rate used is the European Central Bank Euro foreign exchange reference rate published for the relevant date on the ECB website or (if European Central Bank Euro foreign exchange rate is not available) the spot rate of exchange (the closing midpoint) for that currency into EUR on the respective draw date as published on oanda.com. This also applies for annuity payments. However, Lottoland may, in its sole discretion, chose to calculate and credit Winnings in the currency in which the Bet was placed.

12.8         If a non-GB resident User is entitled to legitimate Bet Winnings equivalent to 100,000.00 EUR or more, at Lottoland’s discretion, such Winnings shall be provided to the User in a handover ceremony open to media selected by Lottoland. The User will also give one or more interviews as part of the ceremony but may still choose to stay anonymous. Lottoland may, at its sole discretion, waive these obligations and/or choose an alternative payment method if needed for operational or other reasons. Lottoland may charge the User with the fees arising out of any bank transfer.

12.9         All tier 1 payouts in respect of Bets on the outcome of Betting events are subject to enhanced player verification, third party audits on win validation and payout by the underlying insurers.

13.            Lottoland’s Right to Void Bets and RNG Games

PLEASE NOTE: THE FOLLOWING SECTION CONTAINS IMPORTANT INFORMATION ABOUT LOTTOLAND’S RIGHTS TO VOID BETS AND REFUSE TO PAY WINNINGS IN CERTAIN CIRCUMSTANCES.

13.1         Lottoland is permitted to void any Bets and/or RNG Games played, and withhold any associated Winnings and to take appropriate action under section 14 at its sole discretion if:

13.1.1          Lottoland was requested by a User to place the Bet(s) only after the relevant deadline or after the start of the relevant event and/or if Lottoland erroneously accepted an instruction to place Bets on the Website after the relevant deadline or after the start of the relevant event;

13.1.2          Lottoland becomes aware of a genuine or obvious error, in relation to a Bet or associated event (including any human or technical error in relation to any Bet or any other software used by Lottoland to provide the Website, such as the display of incorrect odds, or markets or bets which remain open as a result of human or technical error after an event has occurred, erroneous win and/or result) whether or not it is subsequently able to contact the User to correct the error, pay a bet at the correct odds and/or confirm the Bet before the deadline;

13.1.3          Lottoland was requested to place the Bet by a User who has provided false, incomplete or expired information in connection with their Account or otherwise in connection with the Website or the Services;

13.1.4          Lottoland was requested to place the Bet by a User who (a) has been involved in any fraud-related activities, collusion, or any other activity which means player funds are not genuinely at risk (whether successful or not) in relation to any Bet, the operation of the User’s Account or otherwise in connection with the Website or the Services; and/or (b) is at the time of the request employed by any lottery operator (including all Underlying Lottery Operators referred to in these Terms and Conditions);

13.1.5          Lottoland is required by law or requested by the police or any regulatory authority to do so;

13.1.6          the outcome is already known when the Bet was placed or the outcome of the relevant event cannot reasonably be determined;

13.1.7          Lottoland was requested to place the Bet by a User who was, at the time of placing the Bet, less than 18 years old;

13.1.8          Lottoland was requested to place the Bet by a User who maintains or maintained more than one Account;

13.1.9          in respect to any Betting event, RNG Games,  our Services or  any other software or hardware used by Lottoland to provide the Website, fraud and/or technical and/or human error or unwarranted influence was found;

13.1.10        where there is a malfunction in any RNG Game, then any bet made during such malfunction shall be deemed invalid and the result null and void, regardless of whether any Winnings have been credited to Users Account or otherwise paid out. Winnings attributed to or obtained by any User in respect of a malfunctioning RNG Game will remain the property of Lottoland. For the purposes of the foregoing “malfunction” will include erroneous results, incorrect return-to-player (“RTP”), better than advertised result, win or pay-out, any fault, glitch or vulnerability in any game mechanic or software (including any background Random Number Generator), or hardware underlying the applicable game or game(s), or its systems, connections or delivery, whether apparent to End User, Lottoland (or both) at time of bet or spin, or latent and only subsequently discoverable (whether by ourselves or any applicable third party) as a part of any win confirmation process. Any stake relating to such Winnings, when ‘rolled into’ subsequent game rounds, spins or bets, shall also be deemed invalid and further results deemed null and void. The User is obliged to return any Winnings obtained as a result of any such malfunction to Lottoland immediately, whether or not on demand.

13.1.11        the Betting event is declared by an organiser or co-organiser as being invalid, incorrect or published in error, as the case may be, or if we have evidence that the integrity of the event or any game or result has been called into question. Evidence of the above may (without limitation) be based on the size, volume or pattern of Bets placed with us across any or all of our betting channels. Any decision given by the governing body of a sport in question will also be considered;

13.1.12        Lottoland reasonably believes that a User has partaken in any of the prohibited activities set out in section 14;

13.1.13        Lottoland reasonably believes that a User has otherwise committed a breach of these Terms and Conditions;

13.1.14        in circumstances where the Alternative Service applies (as set out in clauses 2.30 to 2.35) the relevant Jackpot threshold has been exceeded (please see the Lottery Betting and Financial Market Rules for more information); or

13.1.15        in the circumstances set out in section 1.18 of the Sports Betting Rules (see here).

13.2         If any Bet is voided pursuant to section 13.1.1,  13.1.2, or 13.1.10 Lottoland will offer you the option of placing any such Bet on the next relevant Betting event or crediting your Account with the relevant stake.

14.            Prohibited Activities

14.1         The following behaviour, activities and/or conduct are prohibited and, for the avoidance of doubt, will result in Lottoland being permitted to void Bets placed and withhold Winnings associated with such behaviour, as further set out in clause 13.1 above:

14.1.1          Cheating: Any actual or attempted, cheating, deception or interference in connection with the Services, including taking advantage of evident Service, offer, or payout errors or odds or through the manipulation of any of the RNG Games, or other Services.

14.1.2          Collusion: Attempting to gain an unfair advantage by sharing knowledge with or other information with one or more other Users, or acting in concert with other users to increase overall return from the Services.

14.1.3          Benefiting from errors or malfunctions in RNG Games: Any actual or attempted exploitation of a malfunction (as per 13.1.10) or any known or suspected human or technical errors in relation to any RNG Games (including in relation to any software relating to the RNG Games) which has resulted in the RNG Game crediting a User with Winnings that would not ordinarily have been credited to a User if the malfunction or human or technical error had not occurred, or otherwise seeking to benefit from or exploit any such human or technical error.

14.1.4          Fraud: Any fraudulent or unlawful activity in respect of the use of the Services, including fraudulent payment, for example if you use stolen bank cards, or initiate any unjustified chargeback or other reversal of a payment, or initiate any prohibited transaction (including but not limited to money laundering).

14.1.5          Player Abuse.  For our GB Users this means: Any play, Bet or strategy employed or attempted by User(s) which contravenes the clear terms of any applicable promotion, bonus or offer (for example wagering or betting on products, markets or options which are expressly excluded from the terms of the offer or promotion itself). For our non-GB Players (only) Player Abuse includes both the aforementioned (GB prohibited) play, bets or strategies, plus the following additional play, bets, strategies or attempts which:-

(i)          leverage a corresponding bet on an opposite or similar outcome whether with ourselves or with third party providers / or in concert with other Users to decrease funds risk, enhance player return, or reverse any built-in “house edge” on the applicable Service; or

(ii)         defeat the fundamental premise of fair gaming, or a game of chance at the relayed odds or margin, in which player funds are genuinely at risk; or which

(iii)        seeks to exploit or create any malfunction, hardware, software, systems or human, error or malfunction in relation to the Website Services which has actual or potential bearing upon Bets, Service results, returns, or wins.

15.            Closure of your account

15.1         You may suspend or close your Account at any time upon written request to us.

15.2         Lottoland may suspend your Account at any time to investigate whether any breach of these Terms and Conditions has occurred.

15.3         If you breached any of the terms of these Terms and Conditions, including but not limited to any applicable breach leading to a void Bet or RNG Game in accordance with section 13 above, we may immediately do any or all of the following (without limitation):

15.3.1          issue a warning to you;

15.3.2          temporarily or permanently withdraw your right to use the Website;

15.3.3          suspend or close your Account;

15.3.4          issue legal proceedings against you for reimbursement of all costs resulting from the breach (including, but not limited to, reasonable administrative and legal costs);

15.3.5          take further legal action against you; and/or

15.3.6          disclose such information to law enforcement authorities as we reasonably feel it is necessary to do so.

15.4         If we withdraw your right to use the Website, then you must immediately cease all activities authorised by these Terms and Conditions, including your use of any Services provided through the Website.

15.5         In the case of a suspension of a User Account or temporary withdrawal of a User’s right to use the Website, Lottoland may, at its sole discretion, determine whether any existing Bets will be honoured or voided (provided that it takes the same approach for all existing Bets of the applicable User). If, after suspension of any User Account, Lottoland reasonably believes that it is entitled to terminate the User Account in question permanently, it may choose to do so once any outstanding stakes associated with the User Account for future Bets and/or RNG Games expire or otherwise may at its discretion void such Bets or any RNG Game participations issued or played.

15.6         In the case of termination of a User Account or permanent withdrawal of a User’s right to use the Website, Lottoland:

15.6.1          subject to clause 15.6.2 below, shall refund the payable balance held on the User Account to the User, after both stakes and after any fees incurred have been deducted, and Winnings, for all future and open Bets that the User has already purchased have been settled, using the bank account provided by the User;

15.6.2          may withhold, delay or cancel any Winnings or (as per 15.6.2.1 and 15.6.2.2 or 15.6.2.4) a User’s funds from a User if Lottoland reasonably considers that:

15.6.2.1           there are chargebacks in respect of the relevant User Account or between that User and any affiliate of Lottoland;

15.6.2.2           the Winnings arise from or are otherwise connected to a recent chargeback;

15.6.2.3           the Bet is void, or should be deemed void, in accordance with section 13 ;

15.6.2.4           the applicable funds have been incorrectly credited to the User’s Account, credited in error, or are Winnings from Bets using funds incorrectly credited or credited in error; or

15.6.2.5           Lottoland is required to do so by law or to comply with the instructions of any competent court or governmental, regulatory or enforcement authority (wherever based).

15.7         Multiple Accounts with different email addresses and/or different names for one individual person are not allowed. If, in our opinion, you have more than one Account (“Duplicate Account(s)”), we may elect at any time to: (i) keep your Account and Duplicate Account(s) open; (ii) close your Account and all of your Duplicate Accounts; and/or (iii) keep open the first Account opened by you or on your behalf and close all Duplicate Accounts. If we close any Account or Duplicate Account in these circumstances:

15.7.1          all bonuses, free Bets and Winnings accrued from such bonuses and free Bets obtained using that Duplicate Account will be void and forfeited by you;

15.7.2          we may, at our entire discretion, void all Bets placed using funds in any Duplicate Account and refund to you the amount of any deposits made to the Duplicate Account (less any Winnings withdrawn) and, to the extent not recovered by us from the relevant Duplicate Account, any amounts to be refunded to us by you in respect of a Duplicate Account may be recovered by us directly from any other of your Accounts (including any other Duplicate Account); or

15.7.3          we may, at our entire discretion, allow usage of the Duplicate Account to be deemed valid in which case all Bets placed by or for you through the Duplicate Account shall be retained by us and the balance of any amount remaining in the Duplicate Account which was deposited into the Duplicate Account by you (if any) will be refunded.

16.            Using the Website

General

16.1         You may use the Website for lawful purposes only. You may not use the Website:

16.1.1          in any way that breaches any applicable local, national or international law or regulation;

16.1.2          in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

16.1.3          to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

16.2         Accessing and/or using the Website may be illegal in certain countries. You are responsible for determining whether your accessing and/or use of the Website is compliant with the applicable laws in your jurisdiction and you warrant to us that gambling is not illegal in the territory where you reside.

16.3         Lottoland:

16.3.1          reserves the right to make changes or corrections to, suspend or discontinue any aspect of the Website and the content or services or products available through it from time to time;

16.3.2          does not warrant that that the information on the Website is accurate, complete and up to date; and

16.3.3          is not responsible for any promotional links or advertising banners of third-party advertisers on the Website.

16.4         You agree not to (and not to authorise any third party to):

16.4.1          infringe our intellectual property rights or those of any third party in relation to your use of the Website;

16.4.2          rent, lease, sub-license, loan, translate, merge, reproduce, duplicate, copy or re-sell any part of the Website (including but not limited to the personal information of other Users of the Website);

16.4.3          access without authority, interfere with, modify, reverse-engineer, damage, disrupt or creative derivative works of:

16.4.3.1           any part of the Website;

16.4.3.2           any equipment or network on which the Website is stored;

16.4.3.3           any software used in the provision of the Website; or

16.4.3.4           any equipment or network or software owned or used by any third party, including any software you may need to download to use our services;

16.4.4          combine the Website with, or incorporate it into in, any other programs;

16.4.5          misuse the Website in any way, including without limitation by hacking;

16.4.6          do anything which hinders the performance of the Website;

16.4.7          take any action to conceal or disguise the IP address of the device you are using to access the Website;

16.4.8          infringe or attempt to infringe the privacy of another User of the Website;

16.4.9          take any action to manipulate artificially the Website, odds, feedback and/or ratings systems for whatever purpose;

16.4.10        transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the Website;

16.4.11        use the Website by automated means or otherwise for the purposes of scraping, extracting or otherwise obtaining any material from the Website for use within a third party website or application;

16.4.12        collect or harvest any information or data from the Website or our systems or attempt to decipher any transmission to or from the servers running the Website; or

16.4.13        provide or otherwise make available the Website in whole or in part (including object and source code) in any form to any person without prior written consent from us.

16.5         You must comply with all technology control or export laws and regulations that apply to the technology used or supported by the Website.

Viruses

16.6         We do not guarantee that the Website will be totally secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access the Website and we recommend that you use your own virus protection software.

16.7         You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you could commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.

17.            Intellectual property

17.1         We are the owner or licensee of all intellectual property rights in the Website and the material published on the Website. Those works are protected by intellectual property laws and treaties around the world. All such rights are reserved.

17.2         You are not granted any right to use, and may not use, any of our intellectual property rights other than as set out in these Terms and Conditions. You must not use the Website (or any part of it or its content) for commercial purposes; however, you may download material from the Website solely for non-commercial, personal use by you.

17.3         You may print off one copy, and may download extracts, of any page(s) from the Website for your personal reference.

17.4         You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

17.5         Our status (and that of any identified contributors) as the authors of material on the Website must always be acknowledged.

17.6         You are not granted any right to use, and may not use, any of our intellectual property rights other than as set out in these Terms and Conditions. You may only use the Website for your own domestic, private and non-commercial use. You must not use any part of the materials on the Website for commercial purposes without obtaining a licence to do so from us or our licensors.

17.7         If you print off, copy or download any part of the Website in breach of these Terms and Conditions, your right to use the Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

17.8         No part of the Website, including, without limitation, the text, designs, graphics, photographs and images contained in it, may be copied, reproduced, republished, uploaded, re-posted, modified, transmitted or distributed or otherwise used in any way for any non-personal, public or commercial purpose without our prior written consent.

17.9         Any communications or materials you send to us through the Website by electronic mail or other means will be treated as non-proprietary and non-confidential (other than communications in respect of your order if you use the Website to buy products from us). We are free to publish, display, post, distribute and otherwise use any ideas, suggestions, concepts, designs, know-how and other information contained in such communications or material for any purpose, including, but not limited to, developing, manufacturing, advertising and marketing us and our products.

18.            Our liability

PLEASE NOTE: THE FOLLOWING SECTION CONTAINS IMPORTANT INFORMATION ABOUT LOTTOLAND’S LIABILITY TO YOU IN RELATION TO THIS USER AGREEMENT.

18.1         We endeavour to ensure that the Website is available to Users as much as is reasonably possible, but we cannot and do not guarantee that:

18.1.1          the Website will be available at any specific time or for any specific period;

18.1.2          the Website, including the RNG Games, or the Services, will be free from errors at all times;

18.1.3          that the features, functionality or performance of the Website or the services on it will meet your requirements or those of anyone else; or

18.1.4          that the Website or the services on it or the features and functionality of either of them are, or will be, compatible with, or available on, the device or system used by a User to access the Website.

18.2         We shall not be liable to you save as expressly provided in these Terms and Conditions, but shall have no other obligation, duty or liability to you whatsoever in contract, tort (including negligence), breach of statutory duty or otherwise.

18.3         Nothing in these Terms and Conditions shall exclude or restrict our liability for death or personal injury resulting from our negligence or for fraud.

18.4         We shall not be liable for any loss or damage that may arise from the insolvency of any bank, including (without limitation) any bank with which we maintain our accounts or for delays, losses, errors or omissions in or made by the postal or delivery service of any bank.

18.5         We shall not be responsible for any consequences resulting from major incidents such as any strike, terrorist activities, pandemic, political crisis, war, and saturation of the telecommunication networks, natural catastrophe, or any other matter beyond our control; which could lead to a total or partial reduction, to the access to our services, on internet or by phone. In such an event, we may (in our sole and absolute discretion) cancel or suspend our Services without incurring any liability.

18.6         Without limiting Lottoland’s obligation to pay, transfer or credit Winnings in respect of successful and valid and/or fully confirmed Bets placed and accepted in accordance with these Terms and Conditions:

18.6.1          Lottoland’s liability to any person at any given time shall not exceed an amount equal to:

18.6.1.1           where Lottoland’s liability relates to a Bet – the stake(s) placed by the User on the Bet(s) in respect of which Lottoland’s liability has arisen; and

18.6.1.2           in respect of any other liability of Lottoland – an aggregate of five thousand euros (€5,000).

18.6.2          Lottoland will not be liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise for any loss that could not have been reasonably expected by the User and Lottoland at the time of entering into these Terms and Conditions. Loss or damage would be reasonably expected by the User and Lottoland if it is an obvious consequence of our breach or if it was contemplated by you and us at the time that you opened an Account with us, howsoever caused or arising, whether through non-supply or late supply of the Website or any service available through it, non-performance of these Terms and Conditions, or otherwise.

18.7         Lottoland will not be liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise in respect of:

18.7.1          the refusal to allow any person to place a Bet or refusal to pay Winnings on a Bet in accordance with these Terms and Conditions;

18.7.2          money lost by placing losing Bets;

18.7.3          any losses caused arising from the misuse or unauthorised use of passwords; or

18.7.4          the corruption of data sent by you to us or by us to you;

18.7.5          loss of amenity, enjoyment, disappointment or wasted costs arising from any reasonable decision taken in respect of your Account or Account activity

18.8         Except as expressly stated elsewhere in these Terms and Conditions, all representations, warranties, conditions and other terms, whether express or implied (by common law, collaterally or otherwise) are hereby excluded, except in the case of fraud, or where such exclusion is not permitted by applicable law.

18.9         Nothing in these Terms and Conditions shall affect your statutory rights (which include, for example, that we will provide our services to a reasonable standard and within a reasonable time).

21.            Complaints

21.1         Lottoland’s complaints procedure has three levels. All initial complaints start at level 1, before progressing to levels 2 and 3 in turn. The User may contact Customer Service via email at support@lottoland.co.uk for all three levels of complaint. Each correspondence should be marked as “Complaint” and shall receive a reference number, provided that Lottoland has allocated a reference number to the relevant complaint.

21.2         At level 1, the complaint will be dealt with by an employee from the Customer Operations team. At level 2, the complaint will be dealt with by a Customer Operations Team Leader and/or Shift Supervisor. At level 3, the complaint will be dealt with by Customer Operations Management. Lottoland reserves the right to give a final determination on complaints at any respective stage.

21.3         If you are not satisfied with the result of a complaint and you are a resident outside GB, you may contact the Gibraltar Gambling Commissioner.

21.4         If you are not satisfied with the result of your complaint and you are a resident in GB, while every effort will be made to ensure your concerns are dealt with, should you remain dissatisfied, you can raise your concerns with the alternative dispute resolution service IBAS. IBAS are an independent alternative dispute resolution service who will consider any case regarding betting or gaming transactions. 22.            Variations

We may revise these Terms and Conditions at any time by posting an amended version on the Website. If we update the terms of these Terms and Conditions, the updated terms will apply to each of your uses of the Website from that point on. Some of the provisions contained in these Terms and Conditions may also be superseded by provisions or notices published elsewhere on the Website. We will use reasonable efforts to ensure that any important changes will be notified to you by an appropriate method, such as a notice on the Website. Where any such changes are material  to Users, we will give advance notice of any such changes by alerting you on the home page of the Website and the App and/or via email. However, it is your responsibility to check the Terms and Conditions regularly to take notice of any changes we make, and you agree to do so. If you do not agree with any changes or additions we make, please refrain from using the Website.

23.            Assignment

You may not assign or transfer any of your rights or obligations under these Terms and Conditions. We may at any time and in our sole discretion assign or transfer any of our rights or obligations under these Terms and Conditions to any member of our group (which means our subsidiaries, our ultimate holding company and its subsidiaries) and/or to any third party in conjunction with the transfer of all or part of our business and assets. We will inform you of any transfer and assignment of a contract, whether in full or in part, on the Website. By using the Website and/or placing a Bet on your next visit, you indicate that you accept the transfer and/or assignment.

24.            Waiver

If we fail to insist that you perform any of your obligations under these Terms and Conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

25.            Severance

25.1         Each of the provisions of these Terms and Conditions operates separately. If any provision (or part of a provision) of these Terms and Conditions is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in full force and effect.

25.2         If any invalid, unenforceable or illegal provision would be valid, enforceable or legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the commercial intention of the parties.

26.            Whole agreement

These terms and conditions represent the whole of the agreement between us and you, and replace any previous written or verbal agreement, communicated by or to us.

27.            Third party rights

Except where expressly otherwise provided, these Terms and Conditions are between, and are not intended to give rights to anyone other than, you and us and do not create any third party beneficiary rights. No third party will have any rights to enforce any provision of these Terms.

28.            Governing law and jurisdiction

28.1         These Terms and Conditions are governed by the laws of Gibraltar.  This means that your access to and use of the Website, and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims), will be governed by Gibraltar law. 

28.2         Where these Terms and Conditions are published in several languages, the English version of these Terms and Conditions will supersede and take precedence over any conflicting elements with other languages.

28.3         All transactions including placement or acceptance of any Bet or the payment of Winnings whether contractual or otherwise between Users and Lottoland shall be deemed to be concluded and to take place in Gibraltar where Lottoland's servers are located.

28.4         You can bring proceedings in respect of these Terms in the Gibraltar courts.  However, as a consumer, if you live in the United Kingdom or a European Union member state you can bring legal proceedings in respect of these Terms in either the English courts or the courts of that Member State.

28.5         If you are consumer resident in the United Kingdom or in an EU Member State and we direct the Website to you, you will benefit from any mandatory provisions of the law of the country in which you are resident.  Nothing in these Terms, including clause 28.1 and 28.2 above, affects your rights as a consumer to rely on such mandatory provisions of local law.

SCHEDULE 1

Rules on Lottery Betting and Financial Market Betting

These Rules on Lottery Betting and Financial Market Betting form part of the Terms and Conditions set out in the User Agreement, which can be found here. They are split into Part A: Lottery Betting, and Part B: Financial Market Betting.

All defined terms in these Rules on Lottery Betting and Financial Market Betting are defined in the User Agreement, unless otherwise defined in these Rules.

Part A: Lottery Betting

1.              INTRODUCTION

1.1            Lottoland offers Betting on the results of official lotteries and/or lottery-style draws using certified random number generator technology (“Lottery Betting”), as set out in the User Agreement. Please read the User Agreement in full before carrying out Lottery Betting.

1.2            The terms “Underlying Lottery”; “Underlying Lottery Operator”; “Type A Prize Category”; “Type B Prize Category”; and “Type C Prize Category” have the respective meanings given to them at sections 2.2 and 3.3.

1.3            The term “Prize Category” means the Type A Prize Category, the Type B Prize Category or the Type C Prize Category, as applicable and “Prize” means any prize awarded under a Prize Category.

1.4            The term “RiNG” means the certified random number generator “RiNG” technology used by Lottoland to conduct lottery-style draws.

2.              Winnings

2.1            Lottoland calculates the Winnings for each legitimate winning Bet. The calculation for each winning Bet is in most cases dependent on the Underlying Lottery  and the corresponding Prize Category unless otherwise stated on our Website or within our Terms and Conditions. The table at section 2.2 below sets out how each Prize Category is determined with respect to Lottery Betting.

2.2            Overview of Lottery Betting Prize Category categorisations

2.3            If a lottery draw does not take place or no draw result is published or officially announced, all valid Bets on the relevant Lottery Betting event will stand for the rescheduled draw (or, if there is none, the next available relevant draw) other than in respect of valid Bets placed on:

2.3.1             Austrian Lotto, Austrian Joker,  Spiel77, El Gordo Primitiva, Summer Lottery, El Niño, French Lotto, Irish Lotto, Irish Lotto +1,  Irish Lotto +2, Irish Lotto Pick n Win, Polish Lotto, Polish Lotto+, Swiss Joker, Mark Six (also referred to as “Loto Plus” and “Kinai Lotto”),, Keno 24/7, KeNow, Cash4Life, German Keno, GlücksSpirale or Mexico Melate where all valid Bets will stand and the underlying lottery will be replaced with a lottery-style draw using the certified random number generator “RiNG” technology that will take place at the same time as the official and/or state-run lottery draw was scheduled to take place; or

2.3.2             SuperEnalotto (also referred to as “SuperLotto”), where all valid Bets will stand for the draw of SuperEnalotto GO (using the “RiNG” technology) that takes place either at the same time as the original draw or, if none, the date of the next available SuperEnalotto GO draw.

Winnings in Type A Prize Category

2.4            The Winnings payable in respect of each Lottoland winning Bet in a Type A Prize Category will depend on: (i) the number of winning tickets in the Underlying Lottery in that Prize Category; (ii) the number of Lottoland winning Bets in that Prize Category; (iii) the payable prize by the Underlying Lottery Operator for the Lottery winning tickets in that Prize Category, ad (iv) the Underlying Lottery jackpot (if applicable) in that Prize Category

2.5            Lottoland calculates the Winnings in Type A Category on the basis of the amount of aggregate stakes published by the Underlying Lottery Operator as well as the distribution of the jackpot to that Prize Category, or on the basis of the jackpot published on the Website of the Underlying Lottery Operator for that Prize Category of the relevant draw of the Underlying Lottery. 

2.6            If there is only one Lottoland winning Bet in a Type A, the Winnings payable in respect of this Lottoland winning Bet are calculated as: 

Winnings = Underlying Lottery jackpot in that Type A Category / (Underlying Lottery winning tickets in that Type A Prize Category + 1) 

If the Lottoland winning Bet in a Type A Prize Category is with Doublejackpot, the Winnings are doubled. Note that Doublejackpot does not apply to winning Bets in a Type B Prize Category.

Example: There is only one Lottoland winning Bet in the Type A Prize Category and no Underlying Lottery winning ticket has been announced by the Underlying Lottery Operator in the Type A Prize Category in respect of an Underlying Lottery jackpot in the Type A Prize Category of 90,000,000.00 EUR. The Winnings payable in respect of that single Lottoland winning Bet amount to 90,000,000.00 EUR. 

If there is more than one Lottoland winning Bet in the Type A Category, the Winnings payable in respect of the Lottoland winning Bets in the Type A Prize Category (without NumberShield) are calculated based on a three-step calculation.

Step 1 – Calculation of the number of shares:

Number of shares = Number of Underlying Lottery winning tickets in that Prize Category + Number of Lottoland winning Bets in that Prize Category

Step 2 – Calculation of size of each share: 

Size of 1 share = Underlying Lottery jackpot in that Prize Category / Number of shares 

Step 3 – Allocation of Winnings:

1 share per Lottoland winning Bet (without Doublejackpot and without NumberShield) in the Type A Prize Category

2 shares per Lottoland winning Bet with Doublejackpot in the Type A Prize Category

Example: There are two Lottoland winning Bets in the Type A Prize Category and one Underlying Lottery winning ticket has been announced by the Underlying Lottery Operator in the Type A Prize Category in respect of an Underlying Lottery jackpot in the Type A Prize Category of 90,000,000.00 EUR. There are three payout shares, with a size of 30,000,000.00 EUR each. The Winnings payable in respect of each Lottoland winning Bet in the Type A Prize Category amounts to 30,000,000.00 EUR.

2.7            Winnings for Lottoland winning Bets in the Type A Prize Category with NumberShield are calculated under the assumption that there had been no other Lottoland winning Bets and no Underlying Lottery winning tickets in that Prize Category for the particular draw. Winnings for Lottoland winning Bets with NumberShield are therefore not shared.

2.8            Different rules apply for Lottoland winning Bets for Millionaire Plus (for UK Users: “Millionaire“), Euromillions (for Ireland Users: “Millionaire”), MegaMillions, and  Powerball Lottery Betting event. Please see the Alternative Service, as described at section 2.30 to 2.35 below.

Winnings in a Type B Prize Category

2.9            The Winnings payable in respect of each Lottoland winning Bet in a Type B Prize Category will depend on: (i) the number of winning tickets in the Underlying Lottery in that Prize Category, (ii) the number of Lottoland winning Bets in that Prize Category, (iii) the payable prize by the Underlying Lottery Operator for the Underlying Lottery winning tickets in that Prize Category, and (iv)  the Underlying Lottery jackpot (if applicable) in that Prize Category.

2.10         Lottoland calculates the Winnings in Type B Prize Category on the basis of the amount of aggregate stakes published by the Underlying Lottery Operator as well as the distribution of the jackpot to that Prize Category, or on the basis of the jackpot published on the Website of the Underlying Lottery Operator for that Prize Category of the relevant draw of the Underlying Lottery. 

2.11         If there is only one Lottoland winning Bet in a Type B Prize Category, the Winnings payable in respect of this Lottoland winning Bet are calculated as: 

Winnings = Underlying Lottery jackpot in that Type B Prize Category / (Underlying Lottery winning tickets in that Type B Prize Category + 1) 

If the Lottoland winning Bet is in the Type B Prize Category and with PowerPlay, the Winnings are doubled.

If the Lottoland winning Bet is in the Type B Prize Category and with Megaplier, those Winnings are subject to a multiplier, such multiplier being the number of the first ball drawn in the draw for the Underlying Lottery out of either 2, 3, 4 or 5.

Example: There is only one Lottoland winning Bet in the Type B Prize Category and two Underlying Lottery winning tickets have been announced by the Underlying Lottery Operator in the Type B Prize Category in respect of an Underlying Lottery jackpot in the Type B Prize Category of 9,000,000.00 EUR. The Winnings payable in respect of that single Lottoland winning Bet amount to 3,000,000.00 EUR. If the Lottoland winning Bet utilised PowerPlay, then the Winnings would be doubled to 6,000,000.00 EUR. If the Lottoland Winning Bet utilised Megaplier, and the first ball drawn indicated a multiplier of x3, then the Winnings would be tripled to 9,000,000.00 EUR.

2.12         If there is more than one Lottoland winning Bet in the Type B Prize Category, the Winnings payable in respect of the Lottoland winning Bets in the Type B Prize Category are calculated based on a three-step calculation.

Step 1 – Calculation of the number of shares:

Number of shares = Number of Underlying Lottery winning tickets in that Prize Category + Number of Lottoland winning Bets in that Prize Category

Step 2 – Calculation of size of each share: 

Size of 1 share = Underlying Lottery jackpot in that Prize Category / Number of shares 

Step 3 – Allocation of Winnings:

1 share per Lottoland winning Bet (without NumberShield) in the Type B Prize Category

Example: There are two Lottoland winning Bets in a Type B Prize Category and one Underlying Lottery winning ticket has been announced by the Underlying Lottery Operator in that Type B Prize Category in respect of an Underlying Lottery jackpot in a Type B Prize Category of 3,000,000.00 EUR. There are three payout shares, with a size of 1,000,000.00 EUR each. The Winnings payable in respect of each Lottoland winning Bet in that Prize Category amount to 1,000,000.00 EUR. For a Lottoland winning Bet which utilised PowerPlay, that User’s Winnings would be doubled to 2,000,000.00 EUR. For a Lottoland winning Bet which utilised Megaplier, where the first ball drawn indicated a multiplier of x3, then that User’s Winnings would be tripled to 3,000,000.00 EUR.

2.13         Different rules apply for Lottoland winning Bets for Millionaire Plus (for UK Users: “Millionaire“), Euromillions (for Ireland Users: “Millionaire”), MegaMillions, and  Powerball Lottery Betting event. Please see the Alternative Service, as described at section 2.30 to 2.35 below.

Winnings In a Type C Prize Category

2.14         The Winnings to be paid out in respect of each Lottoland winning Bet in a Type C Prize Category shall be the amount of the prize announced by the Underlying Lottery Operator in respect of an Underlying Lottery winning ticket in the respective Prize Category. If the Underlying Lottery Operator has not announced a prize in the respective Prize Category for the relevant draw of the Underlying Lottery, the Winnings payable in respect of each Lottoland winning Bet in that Prize Category will be calculated on the basis of the aggregate amounts paid in for the relevant draw of the Underlying Lottery announced by the Underlying Lottery Operator and its allocation to the winning Prize Categories.

If a Lottoland winning Bet in the Type C Prize Category is with PowerPlay, the Winnings are subject to a multiplier, such multiplier being the number of the first ball drawn in the draw for the Underlying Lottery out of either 2, 3, 4 or 5. A multiplier of 10 will only apply where the relevant Powerball Jackpot amount is less than $150,000,000 (one hundred and fifty million dollars) and the first ball drawn in the relevant draw is 10.

If the Lottoland winning Bet in the Type C Prize Category is with Megaplier, those Winnings are subject to a multiplier, such multiplier being the number of the first ball drawn in the draw for the Underlying Lottery out of either 2, 3, 4 or 5.

Maximum payouts for Lottery Betting

2.15         The total of all Winnings payable by Lottoland per Prize Category for certain Lottery Betting events must never exceed the numbers set out below. If it the numbers are exceeded, Winnings are divided among the winners.

Daily Millions: 80,000,000.00 EUR (80,000,000.00 GBP for GBP players)

German Keno: 5,000,000.00 EUR

GlücksSpirale and GlücksSpirale GO: Monthly payments of 50,000.00 EUR or 4,800,000.00 EUR as the sum of all future monthly payments.

Irish Lotto+1: 5,000,000.00 EUR

Irish Lotto+2: 1,250,000.00 EUR

Keno 24/7: 10,000,000.00 EUR (10,000,000.00 GBP for GBP players)

KeNow: 5,000,000.00 EUR

Polish Lotto+: 10,000,000.00 PLN

Spiel77 and Spiel77 GO: 10,000,000.00 EUR

Super6 and Super6 GO: 1,000,000.00 EUR

WorldMillions: such amount chosen and advertised by Lottoland

2.16         For all Lottery Betting events, Lottoland may, at its sole discretion, announce a “SpecialJackpot” in advance of the applicable draw. In this case, the SpecialJackpot sum announced replaces any Underlying Lottery jackpot in that Type A Prize Category.

2.17         Only one Prize Category can be won per Normal Bet, which will be the highest of the available Prize Categories achieved by, and relevant to, that Bet. A System Bet can win in more than one Prize Category, based on the separate Bets it is made of.

Other Provisions

2.18         The above provisions apply based on the assumption that there is no payout of Prizes from one Prize Category to another Prize Category, regardless of whether the rules of the Underlying Lottery indicate otherwise. Therefore, in the event Prizes of a higher Prize Category are added to a lower Prize Category, due to either (i) no Underlying Lottery winning tickets in a Prize Category for one draw; (ii) no Underlying Lottery winning tickets in the higher Prize Category for a number of subsequent draws; or (iii) a jackpot cap in respect of the higher Prize Category, this will not be taken into account by Lottoland. Lottoland will only pay out the Prize originally allocated to that lower Prize Category based on the stakes published by the Underlying Lottery and the Prize allocation table of that lottery.

2.19         With respect to payout of Prizes in GlücksSpirale, the monthly payment shall not be paid for longer than 240 months, beginning the month after the relevant draw date. The entitlement to the monthly payment is not inheritable.

2.20         Payout of Prizes in MegaMillions and PowerBall. As is common with MUSL Mega Millions and Powerball, Lottoland may also pay out the Winnings in Type Prize Category over 30 years (the “Annuity Option”). If Lottoland chooses the Annuity Option, the first payment will be made as soon as possible after the draw, with the next 29 payments at one-year intervals. The level of payments is calculated such that the payments rise by the percentage set by MUSL from time to time until the full sum has been paid out. If Lottoland chooses the option to pay out Type A Prize Category Winnings in one lump sum (“Cash Option”), the Type A Prize Category Winnings are paid after withholdings and deductions are made, as it is done in MUSL Mega Millions and Powerball. As an example, if the relevant discount rate is 40% then our Type A Winning is 60% of the Type A jackpot amount after relevant deductions have been made. It is in Lottoland’s discretion to choose the payout plan.

2.21         Lottoland retains 38% withholdings of prizes in the highest three prize categories in MegaMillions and PowerBall because it is intended to put the User in a similar economic position as if they had played the Underlying Lottery (and this deduction reflects the tax that would is payable by a US winner of these draws).

2.22         Lottoland retains 20% withholdings of prizes in the highest three prize categories in SuperEnalotto (also referred to as “SuperLotto”) and SuperEnalotto GO because it is intended to put the User in similar economic position as if they had played Super Enalotto (and this deduction reflects the tax that would is payable by a winner of these draws).

2.23         With respect to Spiel77, all Winnings in a Type A Prize Category are rounded such that they take the form of x,x77,777.00 EUR.

2.24         With respect to Sat Lotto, if the sum of the number of Underlying Lottery winning tickets in a Type A Prize Category and the number of Lottoland winning Bets in that Prize Category is not higher than four, the Winnings to be paid out in respect of each Lottoland winning Bet in the Type A Prize Category shall be not less than 1,000,000.00 AUD. If the sum of the number of Underlying Lottery winning tickets in a Type A Prize Category and the number of Lottoland winning Bets in that Prize Category is higher than four, section 2.4 shall apply.

2.25         Notwithstanding the provisions of this section 2, Winnings in Bitcoin Lottery, Cash4Life, Win Win Charity Lotto (this clause applicable only to UK Players), Keno 24/7, KeNow, Saturday Jackpot, Summer LotteryLotto Plus, Millionaire Plus (also referred to as “Millionaire”), Hatoslottó Plusz (this clause applicable only to Hungary Players), SuperEnalotto (also referred to as “SuperLotto”), WorldMillions and all Lottoland games based on the RiNG are paid out as published on the Website and independent of the Winnings published by the Underlying Lottery Operator (where this Underlying Lottery Operator is not Lottoland).

2.26         The winning numbers for Lotto Plus and Millionaire Plus are taken from "Rychlé Kačky", the number of Underlying Lottery Winning Tickets is taken from (for Lotto Plus;) Camelot's "Lotto" and (for Millionaire Plus:) the official Euromillions.

2.27         For the purposes of Lotto x5, Lotto x5 Draw 2, Lotto x5 Draw 3, Lotto x5 Draw 4 and Lotto x5 Draw 5:

2.27.1          in respect of UK Users only, any reference to Lottoland winning Bets and Underlying Lottery winning tickets shall only refer to Lottoland winning Bets and Underlying Lottery winning tickets in respect of UK Users; and

2.27.2          in respect of non-UK Users only, any reference to Lottoland winning Bets and Underlying Lottery winning tickets shall only refer to Lottoland winning Bets and Underlying Lottery winning tickets in respect of non-UK Users only.

2.28         Some Lottoland Lottery Betting Services offer the “When Jackpot is” feature. This feature allows you to place Bets on a Lottery Betting Service only if the announced jackpot for the relevant Lottery Betting event has reached or exceeded the specified “When Jackpot is” amount.

2.29         Instead of using financial instruments to guarantee the payout of the jackpots and Winnings offered on the Website, Lottoland may also purchase actual entries into underlying lotteries. Lottoland may request winners for such entries to collect prizes directly from the Underlying Lottery Operator. In the event that winnings for such entries incur any taxes, duties or levies, these are to be borne by you. Under no circumstances shall Lottoland have any obligation to pay you an amount an Underlying Lottery Operator may fail to pay out in connection with any winnings for such entries.

Additional Terms for Alternative Service (applicable to Millionaire Plus (for UK Users: “Millionaire”), Euromillions (for Ireland Users “Millionaire”), MegaMillions, Powerball and SuperEnalotto)

2.30         In the event that Type A Prize Category exceeds Lottoland’s jackpot threshold as defined on the product FAQs page on the website, instead of placing a Bet on the outcome of the relevant Underlying Lottery (as detailed in the table at clause 2.2), a User will be requesting that Lottoland purchases a ticket (“Ticket”) via Lottoland’s ticket agent (“Alternative Service”) bearing the same numbers as those selected by the User on the following alternative draws (“Alternative Draws”).

3.3            Overview of Financial Market Betting Prize Category categorisations

 

3.1            With respect to Financial Market Betting:

3.1.1             Other than in respect of Daily Millions:

  if not all financial market data required to determine the Financial Market Betting event winning numbers are available, the financial market data of the next day with all required financial market data being available will be used. For example, if there is no opening value due to a public holiday on Friday, Monday’s opening values will be used.

  if financial market data of a day with an originally scheduled event is used for a previously scheduled event, the financial market data of the next day (with all required financial market data being available) will be used for that originally scheduled event. For example, if a Financial Market Betting event is originally scheduled for Wednesday and Friday and there are no opening values for Wednesday and Thursday due to public holidays, Friday’s opening values would be used for the event originally scheduled for Wednesday and Monday’s opening values will be used for the event originally scheduled for Friday. This only applies to events of the same kind. For example, US Millions can use Friday’s opening values only once. If Friday’s opening values are used for the event originally scheduled for Wednesday, Monday’s opening values will be used for the Betting event originally scheduled for Friday.

3.1.2             In respect of Daily Millions only, in the event that not all financial market data required to determine the Financial Market Betting event winning numbers is available, the event will be moved to the next day when all required financial market data is available and will be used, with subsequent Financial Market Betting events being moved accordingly.

3.1.3             All financial market data will be taken directly from Bloomberg other than if the financial market opening values, required to determine the relevant Financial Market Betting event winning numbers, matches the closing value of the previous day on which the financial market data was available (“Stale Pricing”). In such an event the financial market data from the original source will be used provided there is no Stale Pricing at that level. For example: if, pursuant to the data in Bloomberg, at least one of Friday’s opening values for the NASDAQ equals Thursday’s closing value then we shall use the Friday opening values directly from the NASDAQ if they are different from Thursday’s closing values directly from the NASDAQ. Thereafter:

other than in respect of Daily Millions, in the event of Stale Pricing with Bloomberg and with the original source (for example, NASDAQ), then the financial market data of the next day on which all the required financial market data is available will be used. For example, if at least one of Friday’s opening values equals Thursday’s closing value, Monday’s opening values will be used provided they are different to Thursday’s closing value. However, if Monday’s opening values are equal to Thursday’s closing value then we will turn to the next day until we have an opening value that is different to Thursday’s closing value;

with respect to Daily Millions only, in the event of Stale Pricing with Bloomberg and with the original source, then the Financial Markets Betting event will be moved to the next day that all required financial market data is available with subsequent Financial Market Betting events being moved accordingly. For example, if at least one of Friday’s opening values equals Thursday’s closing value, Monday’s opening values will be used provided they are different to Thursday’s closing value. In this case, the next Daily Millions Betting event will be Tuesday and therefore all Bets placed after Friday’s opening values are published will be moved to the next day that all required financial market data is available, namely Tuesday, provided that Tuesday’s opening values are different to Monday’s closing value. However, if at least one of Friday’s opening values equals Thursday’s closing value and Monday’s opening values are equal to Thursday’s closing value then we will turn to the next day until we have an opening value that is different to Thursday’s closing value.

Winnings in a Type A Prize Category

3.2            The Winnings payable in respect of each Lottoland winning Bet in a Type A Prize Category will depend on the number of Lottoland winning Bets in that Prize Category and the applicable jackpot in that Prize Category.

3.3            If there is only one Lottoland winning Bet in a Type A Prize Category, the Winnings payable in respect of this Lottoland winning Bet are: 

Winnings = jackpot in that Prize Category

If the Lottoland winning Bet in the Type A Prize Category is with Doublejackpot, the Winnings are doubled.

Example: There is only one Lottoland winning Bet in the Type A Prize Category in respect of a jackpot in the Type A Prize Category of 90,000,000.00 EUR. The Winnings payable in respect of that single Lottoland winning Bet amount to 90,000,000.00 EUR. 

3.1            If there is more than one Lottoland winning Bet in the Type A Prize Category, the Winnings payable in respect of the Lottoland winning Bets in the Type A Prize Category (without NumberShield) are calculated based on a three-step calculation.

Step 1 – Number of shares:

Number of shares = Number of Lottoland winning Bets in that Prize Category

Step 2 – Calculation of size of each share: 

Size of 1 share = jackpot / Number of shares

Step 3 – Allocation of Winnings:

1 share per Lottoland winning Bet without Doublejackpot and without NumberShield in the Type A Prize Category.

2 shares per Lottoland winning Bet with Doublejackpot in the Type A Prize Category.

3.2            Winnings for Lottoland winning Bets in the Type A Prize Category with NumberShield are calculated under the assumption that there had been no other Lottoland winning Bets in that Prize Category for the particular draw. Winnings for Lottoland winning Bets with NumberShield are therefore not shared.

Winnings in a Type B Prize Category

3.3            The Winnings payable in respect of each Lottoland winning Bet in a Type B Prize Category will depend on the number of Lottoland winning Bets in that Prize Category and the applicable jackpot in that Prize Category.

3.4            If there is only one Lottoland winning Bet in a Type B Prize Category, the winnings payable in respect of this Lottoland winning Bet are:-

Winnings = Jackpot in that Prize Category

Doublejackpot is not available for Winnings in a Type B Prize Category.

3.5            If there is more than one Lottoland winning Bet in a Type B Prize Category, the winnings payable in respect of the Type B Prize Category are calculated based on a three step calculation.

Step 1 – Number of shares:

Number of shares = Number of Lottoland winnings Bets in that Prize Category.

Step 2 – Calculation of size of each share:

Size of 1 share = jackpot / Number of shares

Step 3 – Allocation of Winnings

1 share per Lottoland winning Bet without without Numbershield in the Type B Prize Category.

Example: There are three Lottoland winning Bets in the Type B Prize Category in respect of a jackpot in the Type B Prize Category of 9,000,000 EUR. There are three payout shares, with a size of 3,000,000 EUR each. The Winnings payable in respect of each Lottoland winning Bet in the Type B Prize Category amount to 3,000,000 EUR.Winnings in a Type C Prize Category

3.6            The Winnings to be paid out in respect of each Lottoland winning Bet in a Type C Prize Category shall be as displayed on the Website.

Payout of Prizes in US Millions and US Power

3.7            Lottoland may pay out the Winnings in Prize Category A over 30 years (the “Annuity Option”). If Lottoland chooses the Annuity Option, the first payment will be made as soon as possible after the relevant Betting event which resulted in the Winnings, with the next 29 payments at one-year intervals. The level of payments are calculated such that the payments rise by 5% until the full sum has been paid out. If Lottoland chooses the option to pay out Prize Category A Winnings in one lump sum (“Cash Option”), the Winnings are paid after withholdings and deductions are made. As an example, if the relevant discount rate is 40%, our Prize Category A Winnings is 60% of the Type A jackpot amount after the relevant deductions have been made. It is in Lottoland’s discretion whether to making payment using the Annuity Option or the Cash Option.

4.              Syndicates

4.1            Winnings for Lottoland syndicate winning Bets are calculated in three steps:

Step 1 – Calculation of total syndicate Winnings:

Total syndicate Winnings = The sum of all Winnings for all Lottoland winning Bets forming part of the syndicate. The Winnings are calculated as set out in section 3 above.

Step 2 – Calculation of syndicate fraction:

Syndicate fraction = Number of shares bought by the User / Total number of shares advertised for the relevant syndicate

Step 3 – Calculation of winnings for this Lottoland syndicate winning Bet:

Winnings for this Lottoland syndicate winning Bet = Total syndicate Winnings * syndicate fraction

Example 1: There is a Lottoland syndicate winning Bet with total syndicate Winnings of 90,000,000.00 EUR. The syndicate fraction is 1 of 9. The Winnings for this Lottoland syndicate winning Bet are 10,000,000.00 EUR.

Example 2: There is a Lottoland syndicate winning Bet with total syndicate Winnings of 30,000,000.00 EUR. The syndicate fraction is 3 of 25. The Winnings for this Lottoland syndicate winning Bet are 3,600,000.00 EUR.

Sports Betting Rules

 

These Sports Betting Rules form part of the Terms and Conditions set out in the User Agreement, which can be found here.

All defined terms in these Sports Betting Rules are defined in the User Agreement, unless otherwise defined in these Rules.

1.              SPORTS BETTING

1.1            Lottoland offers Sports Betting, as set out in the User Agreement and in accordance with the specific rules applicable to each sport (see the “Betting Rules”). Please read the User Agreement in full before carrying out Sports Betting.

1.2            You must not seek to place any Bet if to do so would cause you to breach the Betting Rules or any rules on betting or misuse of inside information relevant to a sports governing body, other professional body of which you are a member, or your employers. If we consider that you may be in breach of any these rules, we may void the applicable Bet(s) in accordance with section 1.19.

1.3            Multiple Bets that combine different selections within the same Sports Betting event are not accepted where the outcome of one affects or is affected by the other. If such a Sports Bet is accepted in error, the Bet will be cancelled and all Winnings will be void and returned to Lottoland.

1.4            Lottoland reserves the right to change odds and information displayed on the Website at any time and without notice. Lottoland will take reasonable care to ensure the accuracy of this information but information is presented as a guide only. Prices displayed on the Website are indicative only and are not binding until a Bet has been accepted by Lottoland. In the event of any particular information relating to Sports Betting (score or time of game, for example) being incorrect, Lottoland assumes no liability for this.

1.5            A Bet is settled once the outcome of that Sports Betting event is determined. Lottoland will always look to settle Bets as soon as the Sports Betting event result is known. However, please allow up to 30 minutes for Winnings to be credited to your Account. In the event Winnings are not credited to your account within 30 minutes, please contact support@lottoland.co.uk.

1.6            The official result from the organiser is final for the purposes of settlement of a Sports Bet, except where specific rules state the contrary. The podium position in Grand Prix racing, the medal ceremony in athletics and any similar official ceremony or presentation in other sports will be treated as the official result.

1.7            If a Bet is not determined during the Sports Betting event, Lottoland will settle the result of the Sports Betting event once the normal duration (regular time) of the Betting event is concluded, unless stated otherwise on the Bet description. For the avoidance of doubt, a football match Bet will be determined after ‘regular time’ of the Betting event, which will be the 90 minutes including any extra minutes added by the referee for injuries and stoppages.

1.8            If a Sports Betting event goes into overtime (when regular time does not decide the winner), only Bets that clearly stated at the point of placement that ‘overtime is included’ will be paid if successful after the completion of overtime. Any penalty kicks (or other decider) that may follow are not taken into consideration, unless clearly stated as part of placing the Sports Bet.

1.9            Sporting Betting events not started on time for any reason or Sports Betting events postponed may be kept open and all Bets remain valid if they kick off (start) within 48 hours of the official start time. In any other case, Lottoland reserves, at its own discretion, the right to void all Bets of such postponed events and refund the stakes to the User.

1.10         If Sports Betting events are abandoned after their official start time and are continued by the official organisers within 48 hours from the original official start time, Lottoland reserves the right to keep all Sports Bets valid and settle according to the rearranged Sports Betting event.

1.11         If Sports Betting events are abandoned after their official start time and it is confirmed by the applicable organiser that the Sports Betting event will not occur within 48 hours of the original official start time, Lottoland will typically settle all determined Bets decided on the pitch at that time and void the rest by refunding stakes to the User. However, in cases falling within the remit of this section 1.11, Lottoland reserves, at its sole discretion, the right to void all Bets of such abandoned Sports Betting events and refund the stakes to the User.

1.12         As an exception to clauses 1.10 and 1.11, tennis games will be kept open with all Bets valid until the officials or organising body declares a winner. In such cases, the 48 hour rule set out above is not valid. However, in case of a player retirement, all Bets already determined on the court are settled accordingly and the rest shall be declared null and avoid. By way of example, if a tennis player retired before the last point was concluded, any match winner Bets would be void, but all markets related to specific sets or games that are already determined will be settled accordingly. 

1.13         For baseball games, when two teams are playing two games in a row, these games are considered as game 1 and game 2 respectively and will be settled as chronologically scheduled. For the avoidance of doubt, if team A play team B twice, the result of game 1 will count for Bets offered on game 1 as originally scheduled and the result of game 2 will count for Bets offered on game 2 as originally scheduled, regardless of whether game 2 is completed prior to game 1 for any reason.

1.14         When a Sports Betting event is cancelled, all Bets related to that event will be void and User’s Accounts will be refunded the amount of the relevant stake for the applicable Sports Bet.

1.15         In case a Sports Betting event is abandoned but there has been at least one scorer, Bets on the first goal scorer market will be settled and Bets on the last goal scorer will be void. The “anytime goal scorer” market for the scoring player is settled as a winner and Bets on other players are void.

1.16         The minimum amount for a Sports Bet is €0.50 (or equivalent currency). The maximum amount for a Sports Bet differs between sports, leagues and bet types. Lottoland make no guarantee that any Bet placed within or for the maximum stake shall be accepted.

1.17         Bets placed on any pre-match markets that have already started will be void unless it is a live Betting event (also known as an in-Play Bet).

1.18         The “Cash out” option gives Users the opportunity to settle the Bet at the value displayed before the market has resulted.

1.19         Without prejudice to any rights in the User Agreement, Lottoland reserves the right to void any Sports Bet (and withhold any associated Winnings):

1.19.1          where Lottoland has reason to believe that a Bet is placed after the outcome of a Sports Betting event is known or after the selected participant or team has gained a material advantage (e.g. a goal, penalty etc.);

1.19.2          where a User is in any way involved in the Sports Betting event (including but not limited to a referee, team coach or player);

1.19.3          if Lottoland has evidence that the integrity of the Sports Betting event (or any aspect of it) has been called into question or spot fixing or match rigging has taken place;

1.19.4          if the User attempts to bypass Lottoland betting limits (potential payout) and risk management by placing multiple, identical or similar bets or opening Duplicate Accounts;

1.19.5          if Lottoland reasonably suspects that the User is in breach of any rules on betting or misuse of inside information relevant to the applicable sports governing body, other professional body of which they are a member, or their employers;

1.19.6          if it is likely that Users have acted in agreement, or as a syndicate. Placing identical Bets from more than one account and from the same IP address might be considered a syndicate. Syndicate betting is considered as fraud and may lead to reduction of limits, closing of account, confiscation of Winnings and cancellation of all placed Bets; and/or

1.19.7          if they are made by any person or group of persons acting in an attempt to defraud Lottoland.

1.20         Lottoland offers the Player the ability to bet on live Sports Betting events, also known as in-play Betting. While Lottoland does try to ensure all live betting information is accurate, there may be times where such information is incorrect due to delays or otherwise. Any ‘live’ feed is provided by a third party and may be subject to a time delay and/or may be inaccurate. When checking live betting odds, live event start times or any other live event markets, please be aware that such information is provided as a guide only and Lottoland accepts no liability for the outcome of any inaccuracies which may occur. It is the sole responsibility of the User to check such information is accurate at the time of publication and that any Sports Bet placed based on this data is entirely at the User’s own risk.

1.21         Lottoland reserves the right, in its sole discretion, not to accept certain multiple bets or to scale back stakes.

1.22         Users should familiarize themselves with sports betting and the terminology. Lottoland cannot accept any responsibility if a User places a Bet in circumstances where the User does not fully understand any of the terms involved or how the Bet operates.

1.23         In order to avoid a Bet not being accepted due to odds changes, the Website automatically updates the odds before any bet confirmation and the User should check the latest odds in the virtual play slip before proceeding. The virtual play slip has the option to automatically accept odd changes or reject them if that is the Users wish.

1.24         Lottoland reserves the right to cancel all Bets of a Sports Betting event if there is any change regarding the venue of the Sports Betting event.

1.25         Lottoland reserves the right to cancel all Bets if there are radical changes in the circumstances of a Sports Betting event including but not limited to the length of playing time, the distance in a race or the number of periods.

1.26         The maximum Winnings per day in respect of Sports Betting is EUR 100,000 (or equivalent currency). If a User places several identical bets (also combinations of single and multiple bets) for which the total Winnings exceed the limit then Lottoland has the right to reduce the bet stake to comply with the Winnings limits.

1.27         Explanation of specific bet types:

1.27.1          “Head-to-Head Bets” are Bets that predict which of the participants will occupy the highest position or will have better results or more points. In order for these Bets to stand, both participants must actively participate in the event. If the two participants achieve the exact same winning result and therefore achieve a tie, all Bets are void;

1.27.2          “Outright Bets” are bets that predict which of the participants (3 or more) will occupy the highest position or will have better results or more points. In order for these bets to stand, all participants must actively participate in the event. If one or more participants don’t participate in the event, then the odds on the remaining participants are recalculated and settled with a reduction in the odds, by applying the probability of the missing participants to the rest of the participants applying the same margin. If two or more participants achieve the exact same winning result and therefore achieve a tie, the applicable odds will be equal to the accepted odds divided by the number of tie participants (e.g. with initial odds 2.70 and there is a 3-way tie, the final odds will be: 2.70 / 3 = 0.90), unless the official governing body chooses only one winner with an additional statistic criterion (e.g. assists);

1.27.3          “Booking market” Bets are Bets whereby a yellow card counts as one card and a red card counts as two cards. If a player gets one yellow plus a second yellow which turns into a red card, this counts overall as three cards. As a result, a player cannot receive more than three cards. Settlement will be based on all available card data that appear during the normal playing time of a Sports Betting event. Cards shown after the final whistle will not be taken into consideration. Cards to non-playing players (players that have already been replaced, coaches, players on the bench who have not taken part in the game) are also not taken into consideration;

1.27.4          “Booking markets with points” Bets are Bets whereby a yellow card counts as 10 points and a red card counts as 25 points. A second yellow leading to a red card counts as 25 points but the second yellow itself will not count. As a result, a player cannot receive more than 35 points. Settlement will be based on all available card data that appears during the normal playing time of a Sports Betting event. Cards shown after the final whistle will not be taken into consideration. Cards to non-playing players (players that have already been replaced, coaches, players on the bench who have not taken part on the game) are not taken into consideration;

1.27.5          “Corners” are Bets whereby the number of corners in a game are counted to determine if a Bet has been won. A corner only gets counted if it has been executed. Corners won by a team but not executed do not count for market settlement, such as if the full-time whistle is blown before team can take a corner; and

1.27.6          “Intervals” is a type of Betting which relates to a certain event(s) occurring in an Interval. For the purposes of these Bets, the 1st minute of a match is 0:00 - 0:59, 2nd minute is 1:00 - 1:59, 3rd minute is 2:00 - 2:59, and so on. For example, the timeframe interval of 15-30 minutes refers to the period 15:00 – 29:59. Occurrences in added injury time at the end of a half will be deemed to have occurred in the Interval which includes the last minute of the respective half or period.
 

SCHEDULE 3

RNG GAMES RULES

1.1            RNG Games allow Users to participate in virtual games offered by Lottoland on its Website, with winning numbers or spins drawn by or decided by certified and tested random number generators.

1.2            A User may Bet on one or more RNG Games. The stake for our scratchcards is determined by the number of IWGs purchased and displayed in the RNG Games section of the Website. All transactions are displayed in the “My Transactions” section of the Website. Lottoland reserves the right to discontinue or to alter RNG Game formats and the right to add RNG Games at its sole discretion, without providing reasons.

1.3            Each RNG Game has a different stake, different prizes and a different pay-out table or prize. The pay-out tables of applicable RNG Games are displayed on applicable pages of the Website. 

1.4            Only one prize may be won per RNG Game, unless stated otherwise. A User can win instant cash-prizes, perpetuity cash-prizes, free RNG Games or spins and physical prizes of any kind as stated on the Website.

1.5            If a purchased Bet is not played within a two week period, Lottoland reserves the right to play the RNG Game on behalf of the User. Any Winnings will be paid out to the User’s Account.

1.6            Each User acknowledges that they participate in any RNG Games  at their own risk and cost. 

1.7            Lottoland shall not be responsible for any downtime, server disruptions, lagging, or any technical or political disturbance to the RNG Games.

1.8            In the event of any error (whether human or technical) in the software relating to any RNG Games, their set-up or operation and/or otherwise in connection with the provision of RNG Games, all affected RNG  Games are void. Refunds may be given solely at the discretion of Lottoland. 

1.9            The User understands and acknowledges that if there is (or if the User is later notified that there is or has been) a malfunction in any RNG Games or their  interoperability, in accordance with clause 13  of the main terms, then any Bet made during such malfunction shall be deemed invalid and the result null and void, regardless of whether Winnings have been paid out. Winnings obtained by a User in respect of any malfunctioning RNG Games shall remain the property of Lottoland. For the purposes of the foregoing, malfunction will include erroneous result,  incorrect Return To Player (“RTP”), better than advertised result, or win, or pay-out, or fault, glitch or vulnerability in the game mechanic or software, or the RNG underlying any game or its system, connections or delivery, and whether apparent to player, Lottoland (or both) or latent and only subsequently discoverable (whether by ourselves or any applicable third party) as a part of any win confirmation process. Any stake from said Winnings played in any subsequent RNG Games round or rounds and the resulting Winnings shall also be deemed invalid and any result deemed null and void. The User is obliged to return any Winnings obtained under this clause immediately to Lottoland, whether or not upon demand.

1.10         In respect of Bingo RNG Games, the User accepts and agrees to the bingo rules which are found here (for UK Users) and here (for Irish Users) and as they are updated from time to time.
